We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

CloutCall is a social prediction game and discovery platform for Non-Fungible Token (NFT) collections. The Service includes but is not limited to:
CloutCall does NOT facilitate the purchase, sale, transfer, or custody of any NFTs, cryptocurrencies, or digital assets. The Service displays publicly available blockchain data for informational and entertainment purposes only.
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.
Each individual may maintain only one account. Creating multiple accounts to manipulate the Service, game the prediction system, exploit the Diamond economy, inflate follower counts, or circumvent any restrictions is strictly prohibited and grounds for immediate termination of all associated accounts.
Diamonds (💎) are a virtual, in-app currency used exclusively within the CloutCall prediction game. Diamonds:
You do not own Diamonds. Diamonds represent a limited, non-transferable, revocable license to use a virtual item within the Service. We reserve the right to manage, regulate, modify, or eliminate Diamonds at any time, with or without notice, and with no liability to you.
Diamonds are non-refundable. Diamonds lost through predictions, rank changes, or any other game mechanic will not be restored. If your account is terminated for violation of these Terms, any Diamonds in your account will be forfeited.
The Service includes a leaderboard mechanic in which Diamonds may be automatically transferred between users based on changes in ranking position. By using the Service, you acknowledge and consent to this mechanic. Diamond transfers resulting from rank changes are final and non-reversible.
Follow credits are a limited resource used to follow other users within the Service. Free users receive a starting allocation and may earn additional credits through engagement. Pro subscribers receive unlimited follow credits.
Follow credits are permanently consumed when used to follow another user. Unfollowing a user does NOT return or refund the follow credit. By following another user, you acknowledge that the credit is permanently spent regardless of whether you later unfollow that user.
Attempting to manipulate the follow system through automated tools, bots, coordinated schemes, or alt accounts is prohibited. We reserve the right to reset follow counts, revoke credits, or terminate accounts engaged in such behavior.
CloutCall offers an optional Pro subscription at the price displayed at the time of purchase (currently $1.99 per year). Pro provides enhanced features including unlimited follow credits, follower visibility, Pro badge, and other benefits as described in the Service.
Pro subscriptions are billed annually. Subscriptions may auto-renew unless canceled before the renewal date. You may cancel your subscription at any time through your account settings or the applicable app store.
Refunds for Pro subscriptions are handled according to the refund policies of the platform through which the purchase was made (Apple App Store, Google Play Store, or web). We do not directly process refunds for subscription purchases.
We reserve the right to modify Pro pricing, features, or availability at any time. Existing subscribers will be notified of material changes before their next renewal date.
“User Content” means any content you submit, post, or transmit through the Service, including comments, chat messages, predictions, and profile information. You retain ownership of your User Content, but by submitting it, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content in connection with operating, developing, and improving the Service.
You agree not to submit User Content that:
We reserve the right, but have no obligation, to monitor, review, edit, or remove any User Content at our sole discretion, for any reason or no reason, without notice.
If you believe any User Content violates these Terms or applicable law, you may report it through the in-app reporting feature or by contacting us at the address provided below.
All NFT data displayed within the Service — including but not limited to floor prices, sales history, rarity scores, trait information, and collection metadata — is provided for informational and entertainment purposes only. We make no representations or warranties regarding the accuracy, completeness, timeliness, or reliability of any NFT data.
Nothing in the Service constitutes financial advice, investment advice, trading advice, or any other form of professional advice. Predictions made within the game are for entertainment purposes only. The prediction game uses virtual Diamonds with no real-world value.
The display of any NFT collection, token, or asset within the Service does not constitute an endorsement, recommendation, or solicitation to buy, sell, or hold any digital asset. We are not affiliated with any NFT project, artist, or marketplace unless explicitly stated.
NFT data is sourced from publicly available blockchain records and third-party data providers. We do not control and are not responsible for the accuracy of third-party data. Floor prices may be delayed, approximate, or derived from multiple marketplace sources.
NFT prices are highly volatile and can change dramatically in short periods. Past performance of any NFT collection is not indicative of future results. You acknowledge and accept these risks when using the prediction game.
The Service displays data from public blockchain networks including but not limited to Ethereum, TRON, Base, Polygon, and BNB Chain. This data is publicly accessible and not proprietary to CloutCall.
NFT images, videos, audio, 3D models, and other media displayed within the Service are sourced from decentralized storage networks (IPFS, BTFS, Arweave) and other hosting locations as referenced in each NFT’s on-chain metadata. We do not claim ownership of any NFT media. Media is displayed pursuant to the metadata published by the respective NFT creators and smart contracts.
The Service does not currently require or support wallet connections. We do not access, store, or manage any private keys, seed phrases, or cryptocurrency wallet credentials.

Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without any obligation to you, including without compensation or attribution.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CLOUTCALL LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

You may stop using the Service and delete your account at any time. Deletion of your account will result in the permanent loss of all Diamonds, follow credits, predictions, comments, and other data associated with your account.
We may suspend or terminate your access to the Service at any time, for any reason or no reason, with or without notice. Reasons for termination may include but are not limited to violation of these Terms, suspected fraudulent or abusive behavior, prolonged inactivity, or discontinuation of the Service.
Upon termination, your right to access and use the Service immediately ceases. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 5 (Diamonds), 8 (User Content), 14 (Disclaimers), 15 (Limitation of Liability), 16 (Indemnification), and 18 (Governing Law).
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may initiate binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the State of Delaware.
YOU AND CLOUTCALL LLC AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CloutCall LLC regarding the Service and supersede any prior agreements.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
We may assign our rights and obligations under these Terms without your consent. You may not assign your rights or obligations without our prior written consent.
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, blockchain network outages, or internet service disruptions.
